Existing transfer equipment is not outlawed by the federal clean air rules, but there has been some confusion about the status of these machines.
Transfer equipment can't be used for new or replacement installations, but transfer equipment installed before Dec. 9, 1991, can remain in operation.
This requirement is still subject to a final EPA rule. Because EPA did not ban new transfer equipment until the final clean-air rules were published in 1993, the agency has proposed "grandfathering" of transfer equipment installed between Dec. 9, 1991 and Sept. 22, 1993. This would allow transfer equipment put in operation by the latter date to remain in operation. EPA will receive comments on that proposal until June 17. If you have transfer equipment that was installed between those two dates, you need to watch for an announcement from EPA regarding the final rule.
